1. OBJETO

Las presentes Condiciones Generales de Venta tienen por objeto regular la oferta y venta a distancia de los productos VIRAGO BARCELONA, a través de la Web www.viragobarcelona.com (en adelante, “la Web”), a los consumidores y usuarios que tengan tal condición de acuerdo a la definición contenida en el Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios (en adelante, “los Clientes”) en España.

La oferta y venta de Productos se realiza a través de la presente Web por SUNDARAYI STUDIO, S.L. (en adelante “VIRAGO BARCELONA”) con C.I.F. B-67460998 y domicilio social en calle Doctor Cabanes Num.50 08221, Terrassa, Barcelona e inscrita en el Registro Mercantil de Barcelona. 

La relación precontractual, contractual y post-contractual celebrada a distancia entre  VIRAGO BARCELONA y los Clientes se rigen por las presentes Condiciones Generales de Venta así como por el Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementaria, por la Ley 34/2002, de 11 de julio, de servicios de la sociedad de la información y de comercio electrónico, así como por cualquier disposición contenida en la normativa que sea de obligado cumplimiento por parte de los empresarios en sus relaciones con los consumidores.

La realización de un pedido por parte del Cliente comporta la plena aceptación sin reservas de las presentes Condiciones Generales de Venta, las cuales deberán ser leídas y aceptadas cada vez que el Cliente realice un pedido y podrán ser imprimidas, almacenadas y reproducidas por los Clientes.

Las presentes Condiciones Generales de Venta están redactadas en español, lengua en la que se formalizará el contrato entre VIRAGO BARCELONA y los Clientes.

VIRAGO BARCELONA podrá modificar, en cualquier momento y sin previo aviso, el contenido de las Condiciones Generales de Venta. Ahora bien, las modificaciones de las Condiciones Generales de Venta, únicamente serán de aplicación a las ventas que se formalicen con posterioridad a la entrada en vigor de la modificación de las Condiciones Generales de Venta.

Las presentes Condiciones Generales de Venta únicamente serán de aplicación a los consumidores, en atención a la definición de los mismos contenida en el Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias o en la norma que la sustituya.

Únicamente podrán contratar con VIRAGO BARCELONA los Clientes que sean mayores de edad, que tengan plena capacidad para contratar y sean residentes en España.

2. PRODUCTOS

El precio indicado de los Productos es el precio al que VIRAGO BARCELONA oferta sus Productos a través de la Web. Dicho precio incluye todos los impuestos que le son de aplicación. No se incluye dentro del precio del Producto los gastos de envío los cuales se indican de forma detallada durante el proceso de compra.

3. PROCEDIMIENTO DE COMPRA

Para poder realizar una compra, el Cliente deberá seleccionar el producto y su correspondiente talla. Después, deberá seleccionar la cantidad de unidades deseadas y añadirlo al carrito clicando  en “Add to Cart”. Una vez finalizada la selección de productos, deberá acceder al carrito (“Cart”) y finalizar su compra accediendo al Checkout. Para formalizar su pedido, es decir, su compra, se deberá introducir el email, seleccionar el tipo de envío y la dirección de entrega e introducir su método de pago (tarjeta bancaria o cuenta de Paypal). Al confirmarse el pedido, recibirá el Cliente en la cuenta de email proporcionada la confirmación de su pedido.

4. MEDIOS DE PAGO

El Cliente podrá realizar el pago del importe total del pedido, incluidos los gastos de envío si los hubiese, mediante los siguientes medios de pago: Visa (credit and debit cards), MasterCard (credit and debit cards), American Express, Discover (US merchants only), Diner's Club, JCB, Apple Pay y Paypal .

5. ENVÍO Y ENTREGA

Únicamente se realizarán entregas en los países especificados en el apartado de Shippings/Envíos. No se hacen envíos a apartados de correos ni a lugares remotos. Sólo se realizan envíos los días laborables.

El precio de los gastos de envío aparecerá detallado en el resumen del pedido en la Web realizado por el Cliente antes de proceder al pago.

Las entregas se realizarán en el plazo que se indica en el apartado de Shippings/Envíos. Es posible que dicho plazo se pueda ver ampliado sin que, en ningún caso, se supere el plazo de 30 días naturales desde la confirmación del pedido. Los pedidos se tramitan una vez recibido el pago. Si el pedido se recibe pasadas las 14.00h (horario local), el pedido se tramitará el siguiente día laborable.

Rogamos a los Clientes que, en el momento de la entrega del pedido por parte del transportista, verifique que los productos entregados se encuentran en perfecto estado y los productos entregados se corresponden con el pedido realizado. En el supuesto de que detecte que los productos están dañados o que no se corresponden con el pedido realizado, rogamos proceda a rechazar el pedido.

Si la compañía de transporte no consigue entregar el paquete dos veces consecutivas, el paquete será devuelto a VIRAGO o lo entregarán en el punto de recogida más cercano y se les comunicará vía email de esa imposibilidad de entrega.

Cualquier cargo o impuesto que surja de un envío fuero de España será responsabilidad del cliente.

6. DERECHO DE DESISTIMIENTO (DEVOLUCIONES)

El Cliente tendrá derecho a desistir del contrato durante un periodo de 14 días naturales (en adelante “plazo de desistimiento”) sin indicar el motivo, a contar desde la fecha de la entrega del pedido.

Para ejercer el derecho de desistimiento, el Cliente, deberá indicar a VIRAGO BARCELONA, dentro del plazo de desistimiento, su intención de desistir del contrato, cumplimentando y enviando el modelo de formulario de desistimiento (para devoluciones) que encontrará al final de las presentes condiciones a la dirección de email info@viragobarcelona.com.

Asimismo, el Cliente podrá indicar su voluntad de desistir del contrato mediante cualquier tipo de declaración inequívoca en la que el Cliente manifieste su voluntad de desistir, por ejemplo, enviándonos un correo electrónico a por correo electrónico info@viragobarcelona.com.

Si el Cliente desiste del contrato, se le reembolsará el importe pagado, incluidos los gastos de envío (a excepción de los costes suplementarios derivados de la eventual elección de un tipo de entrega distinto del tipo menos costoso de entrega estándar ofrecido), sin indebido retraso y, en cualquier caso, antes de que pasen 14 días desde la fecha en que se informó a VIRAGO BARCELONA de la decisión de desistir del contrato. Los gastos de devolución correrán a cargo del Cliente salvo que la devolución se produzca como consecuencia de una falta de conformidad del Producto con el contrato en cuyo caso, VIRAGO BARCELONA se hará cargo de los gastos de devolución del Producto.

El Cliente es responsable de la disminución de valor de la mercancía que se derive de un uso distinto del Producto al necesario para establecer la naturaleza, las características o el funcionamiento de la mercancía.

VIRAGO BARCELONA no procederá a reembolsar el importe hasta que se reciba la mercancía o hasta que se reciba una prueba por parte del Cliente de que se ha reenviado la mercancía, según qué condición se cumpla primero.

7. GARANTÍA DE LOS PRODUCTOS

VIRAGO BARCELONA responde de las faltas de conformidad de los Productos con el contrato durante un periodo de 2 años desde la entrega del Producto en los términos establecidos en el Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias.

8. RECLAMACIONES

Para cualquier queja, sugerencia, incidencia o reclamación, rogamos que el Cliente nos escriba un email a info@viragobarcelona.com.

Asimismo, para la resolución extrajudicial de litigios relativos a obligaciones contractuales derivadas del contrato de compraventa Usted puede dirigirse a la Plataforma de la Unión Europea para la Resolución de Litigios en Línea a través del siguiente enlace:

9. TRATAMIENTO DE DATOS PERSONALES

Los datos personales facilitados serán responsabilidad de VIRAGO BARCELONA, y serán tratados con la debida diligencia y seguridad, cumpliendo en todo caso con las disposiciones legales vigentes en cada momento. La finalidad del tratamiento será la gestión de su pedido online y el mantenimiento de la relación contractual con Usted.

La base legal del tratamiento será la ejecución del contrato de compraventa y los datos personales proporcionados se conservarán mientras se mantenga la relación contractual o durante el tiempo necesario para cumplir con las obligaciones legales.

En ningún caso se contempla por parte de VIRAGO BARCELONA la transferencia internacional de datos personales a terceros países ubicados fuera del territorio de la Unión Europea. 

Sus datos no se cederán a terceros salvo en los casos que exista una obligación legal o sea necesaria su comunicación a terceros proveedores para la prestación de los servicios de mensajería y transporte de su pedido.

Le recordamos su derecho a presentar una reclamación ante la Agencia Española de Protección de Datos en el caso de que considere que se han vulnerado las vigentes disposiciones legales en materia de protección de datos.

Siendo Usted titular de derechos reconocidos en la normativa vigente en materia de protección de datos, podrá ejercer los derechos de acceso, rectificación, oposición, limitación del tratamiento, portabilidad y cancelación dirigiéndose a VIRAGO BARCELONA en la dirección C/Ganduxer 118, 3º2º, 08022 Barcelona o por email a la dirección info@viragobarcelona.com.

10. LEY APLICABLE Y FUERO COMPETENTE

Las presentes Condiciones Generales de Venta, la relación entre el Cliente y VIRAGO BARCELONA, así como cualquier contrato celebrado entre VIRAGO BARCELONA con el Cliente se rigen por la legislación española. 

Para la resolución de cualquier conflicto que pudiese surgir entre VIRAGO BARCELONA y los Clientes que actúen en calidad de consumidores serán competentes los Juzgados y Tribunales españoles en los términos de lo establecido en el artículo 52.3 de la Ley de Enjuiciamiento Civil.

1. OBJECT

The purpose of these General Terms of Service is to regulate the offer and sale of VIRAGO BARCELONA products, through the Web www.viragobarcelona.com (hereinafter, "the Web"), to consumers and users who have such condition according to the definition contained in the Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users (hereinafter, "the Customers") in Spain.

The offer and sale of Products is made through this Website by SUNDARAYI STUDIO, S.L. (hereinafter "VIRAGO BARCELONA") with C.I.F. B-67460998 and registered office at Calle Doctor Cabanes Num.50 08221, Terrassa, Barcelona and registered in the Barcelona Trade Register.

The pre-contractual, contractual and post-contractual relationship held at a distance between VIRAGO BARCELONA and the Customers are governed by these General Terms of Service as well as by the Royal Legislative Decree 1/2007, of 16th November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, by the Law 34/2002, of 11th July, on services of the information society and electronic commerce, as well as by any provision contained in the regulations that are compulsory for employers in their relations with consumers.

The placing of an order by the Customer implies full and unreserved acceptance of these General Terms of Service, which must be read and accepted each time the Customer places an order and may be printed, stored and reproduced by Customers.

These General Terms of Service are written in Spanish, the language in which the contract between VIRAGO BARCELONA and the Customers will be formalized.

VIRAGO BARCELONA may modify, at any time and without prior notice, the content of the General Conditions of Sale. However, the modifications of the General Terms of Service will only be applicable to sales that are formalised after the modification of the General Terms of Service has come into effect.

These General Terms of Service will only be applicable to consumers, in accordance with the definition of the same contained in the Royal Legislative Decree 1/2007, of 16 November, which approved the revised text of the General Law for the Defence of Consumers and Users and other complementary laws or the regulation that replaces it.

Only Customers who are of legal age, have full capacity to contract and are resident in Spain may contract with VIRAGO BARCELONA.

2. PRODUCTS

The indicated price of the Products is the price at which VIRAGO BARCELONA offers its Products through the Web. This price includes all applicable taxes. Shipping costs are not included in the price of the Product and are indicated in detail during the purchase process.

3. PURCHASE PROCEDURE

In order to make a purchase, the Customer must select the product and its corresponding size. Then, he must select the quantity of units desired and add it to the cart by clicking on "Add to Cart". Once the selection of products is finished, the customer must access the cart ("Cart") and finish his purchase by accessing the Checkout. To formalize your order, i.e. your purchase, you must enter your email, select the type of delivery and the delivery address and enter your method of payment (bank card or Paypal account). When the order is confirmed, the Customer will receive the confirmation of his order in the email account provided.

4. MEANS OF PAYMENT

The Customer may pay the total amount of the order, including shipping costs if any, by the following means of payment: Visa (credit and debit cards), MasterCard (credit and debit cards), American Express, Discover (US merchants only), Diner's Club, JCB, Apple Pay and Paypal.

5. SHIPPING AND DELIVERY

Deliveries will only be made to the countries specified in the Shippings section. No deliveries are made to post office boxes or remote locations. Shipments are only made on working days.

The price of the shipping costs will be detailed in the order summary on the Web made by the Customer before proceeding with the payment.

Deliveries will be made within the time period indicated in the section of Shippings/Shippings. It is possible that this period can be extended without, in any case, exceeding the period of 30 calendar days from the confirmation of the order. Orders are processed upon receipt of payment. If the order is received after 14.00h (local time), the order will be processed the next working day.

We ask customers to check, when the order is delivered by the carrier, that the products delivered are in perfect condition and that the products delivered correspond to the order placed. In the event that you detect that the products are damaged or do not correspond to the order placed, please proceed to refuse the order.

If the transport company is unable to deliver the package twice in a row, the package will be returned to VIRAGO or delivered to the nearest collection point and you will be informed via email of this inability to deliver.

Any charges or taxes arising from a shipment outside of Spain will be the responsibility of the customer.

6. RIGHT OF WITHDRAWAL (RETURNS)

The Customer shall have the right to withdraw from the contract for a period of 14 calendar days (hereinafter referred to as the "withdrawal period") without giving any reason, starting from the date of delivery of the order.

To exercise the right of withdrawal, the Client must indicate to VIRAGO BARCELONA, within the withdrawal period, his intention to withdraw from the contract, by completing and sending the model withdrawal form (for returns) that you will find at the end of these conditions to the email address info@viragobarcelona.com.

Likewise, the Customer may indicate his/her intention to withdraw from the contract by means of any type of unequivocal declaration in which the Customer states his/her intention to withdraw, for example, by sending us an e-mail to info@viragobarcelona.com.

If the Client withdraws from the contract, the amount paid, including shipping costs (with the exception of additional costs arising from the possible choice of a type of delivery other than the least costly standard delivery type offered), shall be refunded to the Client without undue delay and, in any event, before 14 days have elapsed since the date on which VIRAGO BARCELONA was informed of the decision to withdraw from the contract. The return costs will be paid by the Client unless the return is due to a lack of conformity of the Product with the contract in which case VIRAGO BARCELONA will be responsible for the return costs of the Product.

The Customer is responsible for any decrease in the value of the goods resulting from a use other than that necessary to establish the nature, characteristics or functioning of the goods.

VIRAGO BARCELONA will not proceed to reimburse the amount until the goods are received or until proof is received from the Customer that the goods have been returned, depending on which condition is met first.

7. GUARANTEE OF THE PRODUCTS

VIRAGO BARCELONA is liable for any lack of conformity of the Products with the contract during a period of 2 years from the delivery of the Product under the terms established in the Royal Legislative Decree 1/2007, of 16th November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws.

9. PROCESSING OF PERSONAL DATA

The personal data provided will be the responsibility of VIRAGO BARCELONA, and will be treated with due diligence and security, complying in all cases with the legal provisions in force at all times. The purpose of the treatment will be the management of your online order and the maintenance of the contractual relationship with you.

The legal basis of the processing will be the execution of the sales contract and the personal data provided will be kept as long as the contractual relationship is maintained or for the time necessary to comply with legal obligations.

Under no circumstances does VIRAGO BARCELONA consider the international transfer of personal data to third countries outside the territory of the European Union.

Your data will not be transferred to third parties except in cases where there is a legal obligation or it is necessary to communicate them to third party suppliers for the provision of courier and transport services for your order.

We remind you of your right to lodge a complaint with the Spanish Data Protection Agency in the event that you consider that the legal provisions in force on data protection have been violated.

As you are the holder of rights recognised by current legislation on data protection, you may exercise your rights of access, rectification, opposition, limitation of processing, portability and cancellation by contacting VIRAGO BARCELONA at the address C/Ganduxer 118, 3º2º, 08022 Barcelona or by email at info@viragobarcelona.com.

10. APPLICABLE LAW AND JURISDICTION

The present General Terms of Service, the relationship between the Customer and VIRAGO BARCELONA, as well as any contract entered into between VIRAGO BARCELONA and the Customer are governed by Spanish legislation.

For the resolution of any conflict that may arise between VIRAGO BARCELONA and the Customers acting as consumers, the Spanish Courts and Tribunals shall be competent under the terms of the provisions of article 52.3 of the Law of Civil Procedure.
